Do Not Fall in a Tram

Tue 12th Jan, 2010

Munich - Who falls down in a tram and injured, has no automatic right for damages sustained, states TZ. According to a rule of the court of Munich, each passenger is himself responsible to hold on in the tram/train and to watch that he does not fall. However, there are some exceptions - and in such cases, the operator must pay the costs of pain and suffering. So, it can not be expected everytime from a passenger that he holds onto something. While getting into a full tram, for example, there is time lapse until everyone stands safely. Also by stamping a ticket the hands must be free. In one specific case, a man in Munich tram had fallen by the tram braking suddenly. He was given only 100 euros instead of his claimed amount for damages sustained on account of pain and suffering of 3000 euros.
